Please read these Terms and Conditions carefully before registering for any Couch Potato Run Club programme. By completing payment and/or attending a CPRC session, you confirm that you have read, understood, and agreed to be bound by these terms in their entirety.

These terms constitute a legally binding agreement between you and the relevant Couch Potato Run Club entity (see Section 02). If you do not agree, you may not register for or participate in any CPRC programme.

Note: These Terms and Conditions do not constitute legal advice. CPRC recommends you seek independent legal counsel if you have questions about your rights and obligations.

“YOU” / “YOUR” The Participant, and where applicable the parent or guardian of a minor Participant.

SECTION 02

THE PARTIES.

These Terms govern the relationship between you and the relevant CPRC entity:

2.1 CPRC:

  • South Africa: COUCH POTATO RUN CLUB (PTY) LTD, Reg. 2022/825572/07.
  • United Kingdom: COUCH POTATO RUN CLUB LTD Company No. SC869764

The entity you contract with is the one operating the Programme you register for (the South African entity for South African programmes; the UK entity for UK programmes). Contact details are in Section 20.

2.2 The Participant: the individual registering for, paying for, or attending any CPRC Programme.

Where a Participant is under 18, their parent or legal guardian is also a party to these Terms and is jointly and severally liable for all obligations under them.

SECTION 03

ACCEPTANCE OF TERMS.

3.1 By completing Registration, you confirm you have read and agree to these Terms in full.

3.2 Attending any Session – even without formal Registration -constitutes acceptance.

3.3 CPRC may request confirmation of acceptance at any time, including at the first Session. Participants who decline may be refused participation with no entitlement to a refund (subject to your statutory rights in Section 06).

3.4 These Terms are in addition to any terms imposed by the Booking System or payment processor.

SECTION 04

PROGRAMME REGISTRATION & ELIGIBILITY.

4.1 Registration is complete on receipt of the required payment through the Booking System (see Section 05 for the deposit option). A confirmation email is sent to the address provided.

4.2 Check your junk/spam folder. Confirmation emails, links, and WhatsApp invitations are automatically generated. CPRC is not responsible for emails filtered by your provider.

4.3 Registration is personal and non-transferable without CPRC’s prior written consent.

4.4 CPRC programmes are open to all fitness levels. There is no minimum fitness requirement to register unless stated for a specific Programme.

4.5 CPRC may refuse or revoke Registration at its discretion, including where a Participant poses a risk to themselves or others, or behaves inconsistently with CPRC’s community values. A pro-rata refund may be considered at CPRC’s discretion.

4.6 Attendance is verified at each Session. Participants must be registered and paid to attend.

4.7 Programme spots are limited and allocated on a first-paid, first-served basis. CPRC does not hold spots without payment.

SECTION 05

PAYMENT & PRICING.

5.1 Programme fees are quoted and charged in South African Rand (ZAR) for South African programmes and in Pounds Sterling (GBP) for UK programmes, inclusive of VAT where applicable.

5.2 A payment-processing fee may apply via the Booking System / payment processor; where charged, it is set by that provider.

5.3 Pricing tiers (e.g. early-bird, general) are time-limited and subject to availability. CPRC does not guarantee any particular tier at the time of your Registration.

5.4 Payment options. You may pay the full Programme fee at Registration, or – where CPRC offers it for a Programme – pay by a two part instalment:

(a) a first payment (the deposit) is charged at Registration to secure your spot;

(b) the second and final payment is charged automatically exactly one month after your first payment, using the card you paid with, processed by our payment provider, Paystack;

(c) by choosing the instalment option, you authorise Couch Potato Run Club and Paystack to securely store your card details and to automatically debit the second payment one month after your first payment. Please ensure sufficient funds are available on that date;

(d) certain benefits (for example your shirt and gift) are released once the second payment has been successfully processed;

(e) if the automatic second payment is unsuccessful, we will contact you to arrange payment. Unpaid balances may result in loss of your spot and/or benefits. The first payment (deposit) is non-refundable except where a statutory cancellation right applies (see the Refund & Cancellation Policy).

(a) a deposit secures your spot at Registration;

(b) the balance is due by the deadline stated for that Programme (typically before the first session of week 4);

(c) certain benefits (for example your shirt and gift) are released only once the balance has been paid in full;

(d) failure to pay the balance by the deadline may result in loss of your spot and/or benefits, and the deposit is non-refundable (subject to Section 06 and your statutory rights).

5.5 CPRC may amend pricing for future Programmes at any time. Changes do not affect confirmed registrations.

5.6 All payments are processed through the Booking System / Paystack. CPRC does not store your card details.

SECTION 06

CANCELLATION & REFUND POLICY.

By completing Registration you acknowledge you have read and accepted this policy. Nothing in this section removes or limits any statutory right you have that cannot lawfully be excluded (see 6.7 and 6.8).

6.1 General rule. Programme fees (including deposits) are non-refundable once paid, regardless of the reason for non-attendance or withdrawal (change of mind, injury or illness, relocation, work, scheduling conflicts, or failure to attend) – except where a statutory cancellation right applies (see 6.7-6.8).

6.1.1 Discretionary exceptions. CPRC may, at its sole discretion and case by case, consider a refund or credit in exceptional circumstances. A request does not create an entitlement. Submit requests in writing to hello@couchpotatorunclub.com before the Programme concludes.

6.2 Programme cancellation by CPRC. If CPRC cancels a Programme in its entirety before it starts, registered Participants will be offered either

(a) a full refund of the Programme fee (excluding processing fees) or

(b) a transfer to an equivalent future Programme.

6.3 Individual session cancellations. Cancellation or postponement of individual Sessions (weather, safety, force majeure) does not entitle you to a refund. CPRC will endeavour to reschedule where practical.

6.4 Missed sessions. No refund, credit or make-up Session for missed Sessions unless CPRC expressly offers one. Missed-session plans are a courtesy, not a contractual obligation.

6.5 Removal from Programme. If you are removed for breaching these Terms, no refund is issued for remaining Sessions.

6.6 Transfer of Registration. CPRC may, at its discretion and on written request made at least 7 calendar days before the first Session, permit a transfer to an equivalent future Programme. No cash refund is issued in lieu.

6.7 South Africa – Consumer Protection Act. Nothing in this policy excludes or limits any right afforded under the Consumer Protection Act 68 of 2008 where such rights apply and cannot lawfully be excluded.

6.8 United Kingdom – statutory cancellation right. If you are a consumer in the UK buying online (a “distance contract”), you generally have a 14 day cooling off period to cancel and receive a refund under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Where you ask CPRC to begin the Programme (or provide digital content) within that 14-day period, you acknowledge that

(i) you may be required to pay for services already provided up to the point of cancellation, and

(ii) the cooling-off right may be lost once the service has been fully performed with your prior express consent.

SECTION 07

HEALTH, MEDICAL & PHYSICAL FITNESS.

7.1 By registering and/or attending, you confirm you are in a suitable state of physical health to take part in a structured walking and running programme.

7.2 Medical clearance. If you have or have had any of the following, obtain written clearance from a registered medical practitioner before participating: cardiovascular disease or any heart condition; high or low blood pressure; diabetes; any musculoskeletal injury or chronic joint condition; respiratory conditions including asthma; any condition currently under medical treatment; pregnancy; or any other condition that may be adversely affected by moderate to vigorous exercise.

7.3 Coaches are not medical professionals. Nothing a Coach says constitutes medical advice. Always consult a qualified practitioner about health or injury concerns.

7.4 You must inform your Coach of any pre-existing injuries, conditions, or limitations before your first Session, and of any changes during the Programme.

7.5 If you feel unwell, faint, dizzy, or experience chest pain, difficulty breathing, or unusual symptoms during a Session, stop immediately and inform your Coach.

7.6 CPRC programmes are beginner-level and designed for gradual progression, but all physical exercise carries inherent risks, including injury, which you accept by participating.

SECTION 08

INDEMNITY & ASSUMPTION OF RISK.

Read this section carefully – it affects your legal rights.

8.1 Assumption of risk. You acknowledge that running, walking, and related exercise involve inherent risks of personal injury, illness or death, including from the actions of others and from environmental conditions (weather, terrain, road surfaces, traffic). You voluntarily assume such risks, to the extent permitted by law.

8.2 Indemnity. To the maximum extent permitted by applicable law, you indemnify and hold harmless CPRC, its founders, coaches, employees, contractors and agents against claims, damages, losses, costs and expenses arising from your participation, including personal injury, illness, death, or loss of or damage to property.

8.3 Limits on this indemnity. This indemnity does not apply to loss caused by CPRC’s gross negligence or wilful misconduct.

Nothing in these Terms excludes or limits CPRC’s liability for death or personal injury caused by its negligence, for fraud, or for any other liability that cannot lawfully be excluded – including, in the United Kingdom, under the Unfair Contract Terms Act 1977 and the Consumer Rights Act 2015, and, in South Africa, under the Consumer Protection Act 68 of 2008.

8.4 Insurance. CPRC strongly recommends all Participants hold adequate personal accident and health insurance. CPRC does not provide personal accident insurance.

8.5 Personal property. CPRC accepts no responsibility for loss, theft, or damage to personal belongings at any Session or event.

SECTION 09

LIMITATION OF LIABILITY.

9.1 To the fullest extent permitted by applicable law, CPRC’s total aggregate liability to any Participant arising out of or in connection with a Programme or these Terms shall not exceed the total Programme fee paid by that Participant for the relevant Programme.

9.2 CPRC shall not be liable for any indirect, consequential, special, punitive or incidental damages.

9.3 Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation – under the Consumer Protection Act 68 of 2008 (South Africa) and the Consumer Rights Act 2015 / Unfair Contract Terms Act 1977 (United Kingdom).

SECTION 10

PARTICIPANT CONDUCT & PROGRAMME RULES.

10.1 Treat all Coaches, Participants and venue staff with respect. Harassment, bullying, discrimination, intimidation or abuse – in person, in a WhatsApp group, or via any channel – will not be tolerated.

10.2 Follow the reasonable instructions of your Coach during a Session. Failure to do so may result in removal.

10.3 Do not attend under the influence of alcohol, recreational drugs, or any impairing substance.

10.4 Do not share another Participant’s personal information, contact details or images without their explicit consent.

10.5 Programmes take place on public roads, footpaths and open spaces. You are responsible for your own safety in relation to traffic and other hazards and must comply with applicable road and pedestrian laws.

10.6 CPRC may remove a Participant from any Session or Programme, and revoke WhatsApp/community access, for any breach. No refund is issued in such circumstances (subject to your statutory rights).

SECTION 11

PROGRAMME CHANGES & CANCELLATIONS BY CPRC.

11.1 CPRC may amend session dates, times, locations, coaches or content at any time for operational, safety or force-majeure reasons, giving reasonable notice via the relevant WhatsApp group.

11.2 CPRC may cancel or postpone individual Sessions (weather, safety, low numbers, or events beyond its control) and will endeavour to reschedule. No refund or credit is issued for postponed or cancelled Sessions.

11.3 CPRC may cancel an entire Programme if minimum numbers aren’t reached or for other legitimate operational reasons. Registered Participants will then be offered a full refund or a transfer to an equivalent future Programme.

11.4 Force majeure. CPRC is not liable for failure or delay caused by circumstances beyond its reasonable control (acts of God, natural disasters, pandemic or epidemic, government action, power failure, flood, fire, civil unrest). Its obligations are suspended for the duration of the event.

SECTION 12

PHOTOGRAPHY, VIDEO & INTELLECTUAL PROPERTY.

12.1 By registering and/or attending, you grant CPRC a perpetual, royalty-free, worldwide licence to use your image, likeness and voice as captured at Sessions and events, for marketing, social media, website, press and promotional purposes.

12.2 Opt-out. If you do not wish to be photographed or recorded, notify your Coach in writing (including via WhatsApp) before your first Session. CPRC will make reasonable efforts to exclude you but cannot guarantee exclusion from all group media.

12.3 CPRC will not knowingly share media that is unflattering, defamatory or harmful.

12.4 CPRC intellectual property. All programmes, interval plans, coaching materials, session plans, branding and content produced by CPRC are its intellectual property. You may not reproduce, distribute, sell or repurpose them without prior written consent.

12.5 Nothing in these Terms grants you any licence to use the CPRC name, logo, branding or trademarks.

SECTION 13

PERSONAL DATA (POPIA & UK GDPR).

13.1 CPRC processes your personal information in accordance with POPIA (South Africa) and the UK GDPR / Data Protection Act 2018 (United Kingdom). Full details – what we collect, why, your rights, and both regulators — are in our Privacy Policy at couchpotatorunclub.com/privacy-policy.

13.2 By registering, you consent to being added to the relevant WhatsApp group and receiving Programme-related communications.

13.3 You may opt out of marketing at any time via the unsubscribe link or by contacting us (Section 20). Operational communications about a Programme you’re enrolled in will continue.

13.4 CPRC will not sell, rent or trade your personal information to third parties for their own commercial purposes.

SECTION 14

WHATSAPP & COMMUNICATIONS.

14.1 CPRC uses WhatsApp as its primary communication channel. By registering, you consent to being added to the relevant group and receiving communications.

14.2 Groups are moderated by your Coach or an authorised representative. The conduct standards in Section 10 apply in full.

14.3 You may not use CPRC groups to advertise, solicit other Participants, or share offensive, defamatory or inappropriate content. CPRC may remove Participants for breach.

14.4 CPRC is not responsible for, and does not endorse, communications sent by individual Participants.

14.5 Coach communications in groups are Programme support only and do not constitute professional medical, legal, nutritional or financial advice.

SECTION 15

MINORS.

15.1 Participants under 18 must obtain written consent from a parent or legal guardian before participating.

15.2 The parent or guardian must sign and submit CPRC’s parental consent and indemnity form before the minor’s first Session.

15.3 By accepting these Terms on a minor’s behalf, the parent/guardian confirms they are authorised to do so and agrees to be jointly and severally liable with the minor.

15.4 CPRC may refuse participation where consent hasn’t been obtained or where participation would not, in CPRC’s reasonable judgement, be in the minor’s best interests.

SECTION 16

ANIMALS AT SESSIONS.

16.1 Where a Programme or Session is designated dog-friendly, Participants may bring dogs subject to this section. Not all Programmes permit animals – confirm per Programme.

16.2 Dogs must be kept on a lead at all times. Participants must clean up after their animals.

16.3 Participants bringing animals are solely responsible for their behaviour and indemnify CPRC, other Participants and Coaches against claims arising from injury, damage or distress caused by their animal.

16.4 CPRC may ask a Participant to remove an animal that poses a risk to others.

SECTION 17

GOVERNING LAW & DISPUTES.

17.1 Governing law depends on where you participate:

(a) For Programmes in South Africa, these Terms are governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the South African courts.

(b) For Programmes in the United Kingdom, these Terms are governed by the laws of England and Wales, and you consent to the jurisdiction of the courts of England and Wales. In each case, any mandatory consumer-protection rights available to you in your country of residence are preserved.

17.2 The parties agree to first attempt to resolve any dispute through good-faith negotiation, initiated by written notice.

17.3 If unresolved within 30 calendar days, the dispute may be referred to mediation – in South Africa, before a mutually agreed mediator or the Arbitration Foundation of Southern Africa (AFSA); in the United Kingdom, before a mutually agreed mediator or an appropriate ADR provider.

17.4 If mediation fails, the parties consent to the jurisdiction of the courts identified in 17.1.

17.5 Nothing prevents either party from seeking urgent interim relief from a court of competent jurisdiction.

SECTION 18

AMENDMENTS.

18.1 CPRC may amend these Terms at any time. The current version is always at couchpotatorunclub.com.

18.2 Where amendments are material, CPRC will give currently enrolled Participants reasonable notice via email or WhatsApp.

18.3 Continued participation after publication of amended Terms constitutes acceptance.

SECTION 19

SEVERABILITY.

19.1 If any provision is found invalid or unenforceable, it is severed and the remaining Terms continue in full force.

19.2 These Terms constitute the entire agreement between you and CPRC regarding your participation and supersede all prior agreements and understandings.

19.3 No waiver by CPRC of any breach is a waiver of any subsequent breach.
